Le 22 avril 1992, le Conseil tribal des Gwich’in et le gouvernement du Canada ont signé l’Entente sur la revendication territoriale globale des Gwich’in (l’Entente) et son plan de mise en œuvre. Le chapitre 5 et l’annexe B de l’Entente prévoit que les Gwich’in, le gouvernement du Canada et le GTNO peuvent négocier des ententes d’autonomie gouvernementale adaptées aux circonstances particulières des Gwich’in et conformes à la Constitution du Canada. Le chapitre 5 de l’Entente prévoit également que la notion d’autonomie gouvernementale tiendra compte du désir des Gwich’in d’exercer leur autonomie gouvernementale à l’échelle communautaire dans la mesure du possible. Une Entente d’autonomie gouvernementale entrerait en vigueur par l’intermédiaire de lois fédérales et territoriales. Le Conseil des Gwich’in Ehdiitat (Aklavik), le Conseil des Gwich’in Gwichya (Tsiigehtchic), le Conseil des Gwich’in Tetlit (Fort McPherson) et le Conseil des Gwich’in Nihtat (Inuvik), représentés par le Conseil tribal des Gwich’in, négocient actuellement une entente relative à l'autonomie gouvernementale des Gwich'in avec le gouvernement du Canada et le GTNO.

Qui sont les Gwich’in?
Les Gwich’in sont des peuples dénés et métis originaires de la région désignée des Gwich’in qui englobe Tsiigehtchic, Fort McPherson, Aklavik et Inuvik.
2. Qui prend part aux négociations?
Des représentants du Conseil tribal des Gwich’in, du Conseil des Gwich’in Ehdiitat (Aklavik), du Conseil des Gwich’in Gwichya (Tsiigehtchic) et du Conseil des Gwich’in Tetlit (Fort McPherson) négocient actuellement une entente sur l’autonomie gouvernementale des Gwich’in avec le gouvernement du Canada et le GTNO.
En septembre 2019, les parties ont signé un accord modificatif sur le processus et le calendrier des négociations relatives à l’autonomie gouvernementale des Gwich’in, qui officialise le retrait des Gwich’in Nihtat du processus de négociations sur l’autonomie gouvernementale régionale des Gwich’in. Depuis, le Conseil des Gwich’in Nihtat (Inuvik) a réintégré le processus de négociation relatif à l’autonomie gouvernementale régionale des Gwich’in.
Pour quoi négocient-ils?
Les Gwich’in négocient actuellement avec le gouvernement du Canada et le gouvernement des Territoires du Nord-Ouest en vue de mettre en œuvre leur droit inhérent à l’autonomie gouvernementale. Le chapitre 5 et l’annexe B de l’Entente sur la revendication territoriale globale des Gwich’in stipulent que le gouvernement et les Gwich’in peuvent négocier des accords sur l’autonomie gouvernementale à l’échelle communautaire en fonction de la situation unique des Gwich’in, et conformément à la Constitution du Canada.
Sur quoi portent les négociations?
Grâce à l’autonomie gouvernementale les Gwich’in pourront établir leur propre gouvernement et prendre leurs propres décisions sur les enjeux qui les concernent. L’accord définitif sur l’autonomie gouvernementale permettra aux Gwich’in de mettre en œuvre leur droit inhérent à l’autonomie gouvernementale en décrivant la structure et les pouvoirs de ce gouvernement.

Negotiation overview
- On April 22, 1992, the Gwich’in Tribal Council and the Government of Canada signed the Gwich'in Comprehensive Land Claim Agreement (GCLCA) and the accompanying Implementation Plan.
- Chapter 5 and Appendix B of the GCLCA provides that the Gwich’in, Government of Canada and the Government of the Northwest Territories (GNWT) can negotiate self-government agreements appropriate to the unique circumstances of the Gwich’in and in conformity with the Constitution of Canada.
- Chapter 5 of the GCLCA also states that self-government will address the Gwich’in desire to negotiate self-government as close to the community level as reasonably possible. A self-government agreement would be brought into effect through federal and territorial legislation.
- The Ehdiitat Gwich’in Council (Aklavik), the Gwichya Gwich’in Council (Tsiigehtchic), the Tetl’it Gwich’in Council (Fort McPherson), and the Nihtat Gwich’in Council (Inuvik) as represented by the Gwich’in Tribal Council are currently in the process of negotiating a Gwich’in Government Agreement with the Government of Canada and the GNWT.

Who are the Gwich’in?
The Gwich’in are Dene and Métis people indigenous to the Gwich’in Settlement Region which surrounds Tsiigehtchic, Fort McPherson, Aklavik, and Inuvik.
Who are the parties involved in the negotiations?
- Representatives from the Gwich'in Tribal Council, the Ehdiitat Gwich’in Council (Aklavik), the Gwichya Gwich’in Council (Tsiigehtchic), and the Nihtat Gwich’in Council (Inuvik), and the Tetl’it Gwich’in Council (Fort McPherson) are engaged in negotiations towards a Gwich’in Government Agreement with the Government of Canada and the GNWT.
- In September 2019, the Parties signed the Gwich’in Self-Government Negotiations Amending Agreement to the Process and Schedule Agreement, which removed the Nihtat Gwich’in (Inuvik) as a Party to the Regional Gwich’in Government negotiation process. Nihtat Gwich’in Council (Inuvik) has since rejoined the Regional Gwich’in Government negotiation process.
Why are the parties negotiating?
- The Gwich’in are negotiating with the Government of Canada and the Government of the Northwest Territories (GNWT) to implement the Gwich’in inherent right to self government.
- Chapter 5 and Appendix B of the Gwich’in Comprehensive Land Claim Agreement provides that Government of Canada, GNWT and the Gwich’in can negotiate self-government at the community level and in a manner appropriate to the unique circumstances of the Gwich’in and in conformity with the Constitution of Canada.
